A] TRUST REGISTRATION PROCEDURE ,REGULATED UNDER THE INDIAN TRUST ACT,1882 -
A non government organization can be registered in India as per above act and below is highlighted the documents required and process of registration done through the Indian trust act ,1882.
REQUIRED DOCUMENTATION FOR TRUST REGISTRATION IN INDIA -
The documents necessary required for the trust registration are as follows -
1] Specific details of the trustees like name , email address , designation , father name , two photographers etc.
2] Address proof of the trust and settlers i.e passport , voter id , driving license , passport etc.
3] Water bill /house tax /electricity bill of the property
4] Rent agreement , NOC from the landlord on 10rs. Stamp , landlord details etc.
5] Settlers presence and two witnesses needed along with id proofs at the time of registration.
REGISTRATION PROCESS -
The registration process as per the Indian Trust act , 1882 is being provided below -
1] Drafting the trust deed
2] Finalization of Non government organization name
3] Determining settler , trustees [minimum 02] and the beneficiary to be named
4] Formation of memorandum of association and executing trust deed having all the clauses and provisions
5] The execution of trust deed must be done on stamp paper
6] All the trustees , settlers must sign the trust deed and should be registered with the local registrar of the region in which NGOs registered offices are located
B] SOCIETY REGISTRATION UNDER SOCIETIES REGISTRATION ACT,1860 -
REQUIRED DOCUMENTATION FOR SOCIETY REGISTRATION IN INDIA -
1] Formation of Memorandum of Association [MOA] by sending covering letter to the government
2] Society rules and regulation letter of copy
3] a list having names of all members of the society
4] Residential proof all members
5] For Rented property NOC of the landlord or address proof
SOCIETY REGISTRATION PROCESS IN INDIA -
1] The registration begins with choosing of appropriate name for the NGO
2] Submission of 02 copies of all relevant documents to the society registrar of the society of state government
3] After evaluation of all the documents provided to the authorities ,if everything appears to be correct as per rules and regulations the Incorporation certificate together with registration number will be provided
C] SECTION 8 COMPANY REGISTRATION GOVERNED UNDER COMPANIES ACT, 2013 -
REQUIRED DOCUMENTATION FOR REGISTRATION -
1] ID proofs and pan card of all the directors /promoters
2]passport size photograph of all the directors ,promoters etc.
3] in case of rental office ,the rent agreement
4] NOC from the owner of the office
5] Company directors detailification
6] Utility bills of registered office
REGISTRATION PROCESS -
1] Choosing an appropriate name for the NGO by filling it through a reserve unique name facility available at the MCA portal.One can place two names at one time .
2] One name shall be approved and therefore one should prepare the memorandum of association and article of association with other documents such as profit and loss statement , asset and liabilities statement etc.
3] The incorporation application shall be filed in the spice form together with other relevant documents .
4] Thereafter doing detailed verification of the documents provided the certificate of incorporation and license will be issued . The COI will contain the identification number along with the TAN number and PN number .
